Welcome to Kisscalapp. This website, dashboard, and the automated scheduling software applications provided under the Kisscalapp brand are owned and operated by Kisscopy44 LLC, a registered limited liability company in New Mexico, USA.

By creating an account, connecting a calendar, or using our booking tools, you agree to comply with and be legally bound by these Terms of Use. If you do not agree to these terms, you must stop using our services immediately.

1. Account Roles & Responsibilities

Our platform allows you to manage automated scheduling configurations. To keep things clear, the following account roles apply:

Account Owners: The business owner or primary administrator who registers the main account. You are fully responsible for all actions taken inside your dashboard.
Staff and Employees: Any individual team members, contractors, or stylists added to the system under your main account to manage schedules and accept client bookings.
Customers: The end-users who visit a public scheduling link to book appointments with you or your staff.

2. User Accounts & Security

Our software allows you and your staff to optionally link external calendar accounts, including Google Calendar, to sync real-time availability.

Permissions: By connecting a calendar, you grant the platform explicit permission to read availability status and write new bookings directly to that calendar.
Staff Authorization: Account owners are completely responsible for ensuring they have obtained proper consent and legal authorization from their employees or staff members before connecting those individuals' personal or corporate Google Calendars to our platform.

3. Google Calendar Integration & Third-Party Permissions

Our software allows you and your staff to optionally link external calendar accounts, including Google Calendar, to sync real-time availability.

4. Payment Processing

If you choose to enable online payment links for your bookings, all financial transactions are securely handled directly by our external third-party payment processing service providers. We do not process, view, or store credit card details or transaction fees on our servers.

5. No Software Liability & Warranty Disclaimer

Kisscalapp relies on external networks (like Google APIs and telecommunication networks) to sync bookings and send reminders. We do not guarantee uninterrupted or error-free operations. Kisscopy44 LLC is not legally or financially liable for missed meetings, double-bookings, network delays, or API sync downtimes.

YOU AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. You are solely responsible for ensuring compliance with all applicable local laws and industry-specific regulations in your use of the Services. The Provider assumes no responsibility or liability for your regulatory compliance failures within your specific field or profession.

6. Prohibited Uses & Limitation of Liability

You agree not to use Kisscalapp to deploy automated scraping software, malicious hacking bots, distribute unsolicited spam messages, create fraudulent booking notifications, or copy features to build a competing software product.

SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH: Service Content and Errors, Unauthorized Access or Breach, Service Interruptions, Viruses and Malicious Code, or Service Usage or Inability. To the fullest extent permitted by law, the Provider's total liability to you for any damages arising from any cause will not exceed the amount of your last payment for the Services that caused such damages. Your only remedy for any dispute is to stop using the Services.

7. Account Deletion & Cancellations

You can disconnect your Google Calendar integration or request the total deletion of your user account at any time through your dashboard settings. Upon deletion, your active API tokens are revoked and your dashboard records are securely removed from our active database.

8. Third Party Websites

Users may find advertising or other content on our Site that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site.

9. Changes to These Terms

Company has the discretion to update these Terms of Use at any time. When we do, we will update the date at the top of this page. You acknowledge and agree that it is your responsibility to review these terms periodically and become aware of modifications.

10. Indemnification

You agree to defend, indemnify, and hold harmless Kisscopy44 LLC, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of and access to the Services, your violation of any term of these Terms of Use, or your violation of any third-party right or applicable industry privacy laws.

11. Text Messaging Terms

By providing verbal consent during a phone conversation to receive video links or product information via text message from Juan or our outbound sales team, you agree to receive messages from us. Message frequency varies based on customer interaction. Standard message and data rates may apply. You can reply STOP at any time to opt out of future text communications.

12. Governing Law

These Terms of Use and any legal disputes relating to the platform shall be governed by and construed in accordance with the laws of the State of New Mexico, USA, without regard to conflict of law principles.
